Abstract

In recent years, political polarization, social division, racial antagonism and economic recession are becoming prominent domestic problems in the United States. In order to deflect domestic contradictions, the former Trump administration cracked down on China’s development irrationally and imposed extreme sanction measures on China, causing serious damages to China-US relations. Due to the comprehensive changes to the national strength of China and the United States, the bipartisan consensus of showing strength and strategically cracking down on China has been reached. The transition of the United States administration will not change its basic strategy direction to China. In the future, it cannot be ruled out that the US government will shift from the "hard decoupling" of the former Trump era to the "soft containment" of the Biden era, to further adopt domestic legislation and the issuance of presidential executive orders to promote awareness of issues in the feld of morphology, related to Taiwan, Hong Kong, ethnic religions, and human rights protection, adopting a more obscure approach to contain and suppress China’s development. At the Conference of Law-based Governance of CPC, General Secretary Xi Jinping clearly pointed out that we must persist in the overall promotion of the domestic rule of law and foreignrelated rule of law, and this issued the mobilization order for China to respond to external legal risks and challenges with rule of law minds and rule of law measures. Therefore, under the framework of international law, China must accelerate the construction of the domestic legal system for extraterritorial application, step up its ability to respond to and counter the US unilateral sanctions in human rights, and comprehensively use legislative, law enforcement and judicial means to properly respond to external legal risks and challenges, and the negative impact of economic and social development, safeguarding China’s national sovereignty, security and development interests.
